Independence · written procedure
No one reads the merits until the conflict check is clear.
Every order, application and case starts with a conflict check by the Registrar. It usually takes two working days.
The steps
| Step | What happens | Time |
|---|---|---|
| 1. Names | The Registrar records every party, counsel, funder and known affiliate from the form. No documents are opened. | Day 0 |
| 2. Search | Names are checked against all UNIONE™ matters, the Fellows directory and the Council and Board registers of interests. | Day 1 |
| 3. Fellow declaration | The proposed Fellow declares any connection with the parties in writing, under the IBA Guidelines on Conflicts of Interest. | Day 1–2 |
| 4. Decision | Clear: the Fellow is assigned. Disclosable: the parties are told and can object. Conflict: another Fellow is proposed, or the matter is declined and any fee refunded. | Day 2 |
| 5. Record | The check and the declarations are kept on the matter file. Continuing duty: a Fellow discloses anything new at once. | Throughout |
Who can never be assigned
- A Fellow with a current or recent (three years) professional relationship with a party or its counsel.
- A Council or Board member, in any matter UNIONE™ administers.
- A Fellow who assessed or reviewed the same dispute, for a later appointment, unless every party consents in writing.
