What is UNIONE™?

UNIONE™ is a cross-border arbitration and dispute resolution institution. It connects contract and prevention work, structured resolution, institutional arbitration and enforcement readiness within one wider dispute lifecycle.

Is UNIONE only an arbitration institution?

Arbitration is central to UNIONE. The institution also provides connected routes before formal proceedings and after an award or enforceable right, so users can enter at the stage relevant to the problem.

Where should a business start?

Start with the decision, not the product name. A contract question normally begins with Before You Sign™. An emerging or live dispute can begin with Before You Arbitrate™. A formal arbitration can begin through Arbitration or File a Case. Recovery and recognition questions can begin with Before You Enforce™.

Does using a pre-arbitration UNIONE service automatically make it a condition precedent to arbitration?

No. A prevention, assessment or structured resolution process becomes mandatory only where the parties have contractually adopted that requirement or the applicable procedural framework expressly provides for it.

ARBITRATION

How do I commence a UNIONE arbitration?

Use the File a Case route and submit the information and documents required by the applicable Rules. The institution will then administer the matter in accordance with the operative procedural framework.

What Rules currently govern?

The website must show the operative Rules and effective date clearly. Rules & Procedures v4.0 are currently presented as an Institutional Draft under Adoption Review and are not yet effective unless and until formally adopted.

Can parties choose a different procedure track?

The applicable Rules, party agreement, dispute characteristics and institutional powers determine the available procedure. UNIONE is developing proportionate tracks including Simplified, Expedited and Standard procedure, but final eligibility and consequences must follow the adopted Rules.

Is emergency relief available?

UNIONE provides an Emergency Arbitrator route where the applicable arbitration agreement and operative Rules permit it. Parties may also retain rights to seek urgent court relief where the applicable law and Rules allow.

Are Fellows automatically appointed as arbitrators?

No. Fellowship, Sector Bench standing, Council membership or prior participation creates no entitlement to appointment. Any appointment is separately determined under the applicable Rules, party rights, independence, conflicts, suitability and availability.

How should UNIONE be written into a contract?

Use the current Model Clauses page and select the clause architecture appropriate to the transaction. Parties should not rely on an outdated clause copied from an older page or document.

Are the v4.0 Rules already effective?

No. Until formal adoption, v4.0 must remain labelled Institutional Draft - Adoption Review - Not Yet Effective. When adopted, the effective date and transitional position should be published clearly across the site.

Where can I find the fees?

The Fees page should contain the current institutional fee pathway and explain which charges are administrative, tribunal-related or service-specific. Only current approved fees should be quoted.

Does UNIONE guarantee an award will be enforceable?

No. Enforcement depends on the award, applicable conventions and laws, jurisdiction, procedural history, assets and other facts. UNIONE can support enforcement readiness and jurisdiction intelligence without guaranteeing recognition or recovery.

What is DPC™?

DPC™ is UNIONE’s dispute prevention framework. It can be used to identify dispute-facing weaknesses, structure escalation and support early intervention. It does not guarantee that a dispute will be avoided.

What is Independent Assessment™?

Independent Assessment™ is a structured review of a claim, defence, evidence, exposure or decision question. It supports commercial decision-making and does not replace the tribunal where binding adjudication is required.

Can a Standing Neutral later become an arbitrator?

Not automatically. Any later role must be considered separately under the applicable conflict, independence, consent and procedural safeguards.

Are settlement or evaluation materials automatically available to a later tribunal?

No. The transition between prevention, evaluation, settlement and arbitration should preserve applicable confidentiality, without-prejudice protection and role separation unless the parties and applicable framework provide otherwise.

What is Before You Enforce™?

It is the UNIONE route for analysing recognition, assets, jurisdiction, security, State or SOE issues and recovery strategy before or after an award or enforceable right exists.

What is ERR™?

ERR™ is an enforcement-readiness review where the applicable UNIONE process provides for it. It should focus on procedural, formal and execution-facing risk. It does not decide the merits and does not certify guaranteed enforceability.

Does UNIONE provide domestic-law advice in every country?

No. Where domestic-law advice, court representation or another locally reserved activity is required, appropriately qualified local counsel should be engaged. UNIONE can identify the dependency and coordinate relevant input where appropriate.

Fellowship is institutional professional standing. It can support professional visibility, participation and Sector Bench relevance, subject to the applicable designation and review process.

Does Fellowship guarantee referrals or paid work?

No. Fellowship does not guarantee appointments, cases, referrals, client work or any commercial result.

How do I express interest in Fellowship?

Use the current Expression of Interest page. The first stage should collect professional information for review. Payment should follow approval where applicable, not precede professional evaluation.
