DPC™ · Dispute Prevention Framework

Review the dispute-facing architecture before a contract problem becomes a formal dispute.

DPC™ is UNIONE™’s institutional prevention framework for eligible cross-border contracts. It can identify dispute-facing weaknesses, structure remediation and create a disciplined escalation pathway during performance.

01 · What DPC™ does

DPC™ is a prevention framework - not a promise that disputes will not arise.

The purpose is earlier visibility, clearer escalation and a better contract record.

Clause / forum

Is the dispute clause internally coherent?

Review seat, rules, governing-law interaction, multi-tier process and obvious architecture issues.

Notice / evidence

Can the parties preserve rights and records?

Notice, milestones, records, decision ownership and escalation.

Remediation

Can weaknesses be corrected before they harden?

Advisory identification and contract / process remediation where appropriate.

Standing Neutral

Is an ongoing neutral relationship separately established?

Any Standing Neutral role depends on the applicable DPC terms, contract and conflict-safe engagement.

02 · Operating discipline

A safe DPC™ operating path.

The framework should never imply automatic enforceability, automatic neutrality or guaranteed dispute avoidance.

01

Qualifying intake

Confirm that the contract and requested scope fit the DPC™ framework.

02

Review

Assess the defined dispute-facing checkpoints and identify assumptions / weaknesses.

03

Advisory remediation

Give the parties a clear opportunity to correct or clarify issues where appropriate.

04

Institutional record

Record the DPC™ outcome under the applicable framework without describing it as a court-proof guarantee.

05

Ongoing prevention

Where separately agreed, use escalation / Standing Neutral mechanisms without predetermining any later tribunal or expert appointment.

Prevention before procedure

A DPC™ review can improve dispute readiness without converting the contract into a guaranteed enforcement instrument.

The contract, governing law, later facts and the competent tribunal / court continue to determine legal consequences.

03 · Institutional boundary

DPC™ does not certify that a contract is universally enforceable.

It is institutional prevention and decision support.

Professional boundary

Contract validity, domestic mandatory law, regulatory matters, court remedies, enforceability and other jurisdiction-specific conclusions require appropriately qualified local counsel where applicable.

Appointment / work firewall

Fellowship, Sector Bench, Council, certification-board, DPC, assessment or prior institutional participation creates no entitlement to arbitral, expert or neutral appointment, referral, client work, case allocation or any particular outcome.

Rules status

UNIONE™ Rules & Procedures v4.0 remain Institutional Draft - Adoption Review - Not Yet Effective. Draft procedures are not operative merely because they appear on an institutional page, solution description or draft rule text.
