Institutional Governance

How UNIONE™ is governed.

Four independent bodies, each with a defined mandate that does not overlap with the others. The structure is designed so that no single body - and no external interest - can influence institutional decisions on appointments, rules, or conduct.

The Four Governing Bodies
Body 01
Appointments
Committee
Responsible for all tribunal and Standing Neutral appointments. Decisions are final.
Mandate
Makes all tribunal appointments where parties cannot agree. Makes all Standing Neutral appointments under the DPC framework. Reviews conflicts disclosures. Considers specialism, jurisdiction, language, availability, and independence at every appointment.
Independence
Does not take instructions from parties, from the Secretariat, or from other institutional bodies. Committee members who have a conflict on any appointment are recused from that decision. Appointment decisions are not subject to institutional appeal.
Body 02
Rules & Standards
Committee
Maintains, reviews, and amends UNIONE™ Rules v3.0 and the DPC Standard.
Mandate
Periodic review of Rules v3.0 and the DPC Standard v1.0. Proposes amendments based on case experience, enforcement developments, and practitioner feedback. Manages version control and publishes changelogs for all rule amendments.
Process
Rule amendments are subject to a consultation period before adoption. Amendments do not apply retrospectively to proceedings commenced under a prior version. The current version of the Rules is always published in full at theunione.org/rules.
Body 03
Ethics & Conduct
Panel
Handles complaints against Fellows and conducts disciplinary proceedings.
Mandate
Receives and investigates complaints about Fellow conduct. Conducts disciplinary proceedings where warranted. Issues sanctions up to and including removal from the Fellowship. Operates independently of institutional management.
Process
Complaints are submitted in writing to ethics@theunione.org. The Panel acknowledges receipt within 5 business days. The Fellow subject to a complaint is notified and given the opportunity to respond before any decision is made. Decisions are published in redacted form.
Body 04
Institutional
Council
Strategic oversight of the institution's development. Does not intervene in individual cases.
Mandate
Sets institutional policy and strategic direction. Reviews and approves major institutional decisions - fee schedules, institutional partnerships, structural changes. The founding Fellows cohort will be represented on the Council from August 2026.
Limits
The Council does not intervene in individual cases, appointments, or disciplinary proceedings. It sets policy - it does not adjudicate. This separation is structural, not procedural: the Council has no mechanism by which to influence individual appointment or conduct decisions.
The Secretariat

It administers.
It does not decide.

The Secretariat manages day-to-day institutional operations - case filing, fee collection, correspondence, document management, and the administration of the DPC Registry and Fellows Register.

It has no role in tribunal constitution decisions, rules development, or conduct investigations. This is structural. The Secretariat does not have access to the Appointments Committee's deliberations, the Ethics Panel's proceedings, or the Rules Committee's drafting process.

UNIONE™ International Arbitration is an extension of The Neutrals.ORG and part of Federation of Integrated Conflict Management incorporated in India. Administrative headquarters are in Delhi.

We are establishing a dedicated independent institutional entity for UNIONE™. This is the standard development path for new arbitration institutions. The transition will be announced when complete.

Independence Safeguards
No state or government affiliation
UNIONE™ has no affiliation with any government, state body, or national bar association. It receives no state funding and operates under no state mandate.
IBA Guidelines compliance
All tribunal and Standing Neutral appointments operate under the IBA Guidelines on Conflicts of Interest in International Arbitration. Declaration of independence is mandatory at appointment.
Published governance documents
All UNIONE™ institutional rules, standards, and governance documents are published openly. No institutional document that affects parties or Fellows is kept confidential from those affected by it.
Separation of function
The four governing bodies do not share personnel. A member of the Appointments Committee cannot simultaneously serve on the Ethics Panel or Rules Committee.
Mandatory recusal
Any committee member with a conflict on a specific matter is recused from that decision. Recusal is self-declared and verified by the committee chair.
Rules versioning & retrospectivity
Rule amendments apply to proceedings commenced after the amendment date only. Parties filing under Rules v3.0 are governed by v3.0 for the life of their proceedings.

The Rules & Standards Committee initiates a review where case experience, enforcement developments, or practitioner feedback identifies a gap or ambiguity in the Rules. Proposed amendments are circulated for comment before adoption. The current version is always the operative version for new proceedings.

Complaints & Conduct

How complaints are handled.

Complaints about Fellow conduct are submitted to ethics@theunione.org. The Ethics & Conduct Panel acknowledges within 5 business days, notifies the Fellow concerned, and conducts its investigation independently. Outcomes are published in redacted form on this page.
