How are arbitrator fees determined?
Arbitrator fees are set in accordance with Article 53 of the UNIONE™ International Arbitration & Dispute Resolution Rules v3.0. UNIONE™ may adopt fixed or tiered fee models depending on the nature and value of the dispute. Fees are disclosed to parties in advance of Tribunal constitution and are subject to UNIONE™ approval. The precise fee structure is communicated upon case registration.
Is the ERR fee included in the institutional fee?
Yes. The Enforcement Readiness Review (ERR) fee is included within the UNIONE™ institutional fee schedule. There is no additional charge for the ERR or for the issuance of the Enforceability Certificate. Both are included as part of the standard UNIONE™ process under Articles 42 and 43 of the Rules.
What happens if the claim value changes during proceedings?
Where the claim value increases significantly during proceedings - for example, due to counterclaims or additional claims - UNIONE™ may request an additional administrative deposit proportionate to the revised claim value. Any such request will be communicated to the parties in advance.
Are fees refundable if the case settles?
Registration fees are non-refundable. Administrative fees paid as advances on costs may be partially refunded if proceedings are terminated before the Tribunal is constituted, subject to any costs already incurred by UNIONE™. UNIONE™ will provide a cost accounting upon termination.
Can fees be split between the parties?
Yes. UNIONE™ requires advances on costs from both parties by default. Where one party fails to make required payments, the other party may make such payment and seek recovery in the Award. The allocation of costs as between parties is ultimately determined by the Tribunal in the Award.
How do UNIONE™ fees compare to ICC, LCIA or SIAC?
UNIONE™ fees are designed to be competitive with and in many cases below equivalent fees at the ICC, LCIA and SIAC - particularly for mid-value disputes in the USD 1M–10M range where those institutions' tiered models can generate significant administrative costs. A formal comparison is available on request from the UNIONE™ Registrar.
